Dr. John Eastman Takes Disbarment Fight to U.S. Supreme Court
Dr. John Eastman is taking his fight over his California disbarment to the Supreme Court of the United States.
Today, Dr. Eastman filed a petition for a writ of certiorari asking the Supreme Court to review the California Supreme Court’s order stripping him of his California law license. Lex Rex Institute attorney Alexander Haberbush, who was part of Dr. Eastman's legal team at every stage of these disciplinary proceedings, continues to represent him before the Supreme Court alongside attorneys from the American Center for Law & Justice.
The case asks a question that reaches far beyond Dr. Eastman: Can a State take away a lawyer’s license because of the legal arguments he made for his client in one of the most politically charged controversies in the country's history?
California disciplined Dr. Eastman over legal advice, court filings, public commentary, and communications with government officials arising from his representation of President Donald Trump after the 2020 election. Even the courts that ruled against him acknowledged that the challenged statements involved core political speech. Dr. Eastman now asks the Supreme Court to hold that California failed to afford that speech the First Amendment protection the Constitution requires.
The stakes are larger than one lawyer or one election. Dr. Eastman’s filing asks the Court to clarify whether attorneys remain free to represent controversial clients, press unsettled constitutional theories, and petition government officials without risking professional discipline merely because the state bar dislikes their client or the legal position they advanced is later rejected.
